Radio Performance Tax

As the issue of Performance Royalty Tax moves on, several phone calls to Paul Kanjorski have gone un-returned. Below is an update sent from Richard Wyckoff of the Pennsylvania Assocation of Broadcasters.

Memo to PAB Radio Executives:


First, allow me to congratulate those of you who reached out to educate your federal legislators and got them to co-sponsor H. Res. 49 – opposing any Performance tax. We now have over one half of the House with us - 11 from Pennsylvania.

However, I understand legislators who favor taxing us will continue to push House Leadership to go forward with a vote in the full House. A Music First spokesman points out that H.Res 49 is a nonbinding resolution and that “every legitimate concern” about a royalty has been addressed in their bill. Music First hopes to take some of our supporters away before that vote.

We should not sit on our hands. We have Pennsylvania legislators who have not yet signed on [including Paul Kanjorski: 2188 Rayburn House Office Building, Washington DC 20515 / Phone: 202-225-6511 / Fax: 202-225-0764.]

Pennsylvania stations will pay over $63,000,000 in fees if the tax is enacted.

We should not forget that these fees will go up each year. What is $2,500 this year will not be so next. Music First only added the lower fees in hope of dividing our stations. Why should you even pay $500 a year when you promote performers with each song played? You sell their songs and sell concert tickets.

What is even more amazing is that their bill will give the Record Companies (3 of the 4 are foreign owned) almost 50% of the new revenue – half won’t go to the performers! The labels have a long, sordid history of abuse of their performers and their greed has no limit.

If your legislator is not on H. Res 49, please make contact. Ask for the order. Only 300 co-sponsors will stop the RIAA and its supporters from moving forward or reintroducing this next session. Please lend a hand and let’s sign up every Pa. House Member.
